In a landmark development, Justice Aminuddin Khan has been appointed as the first Chief Justice of the newly established Federal Constitutional Court of Pakistan (FCC), following the signing into law of the Twenty‑seventh Amendment to the Constitution of Pakistan.
The amendment, approved by both houses of Pakistan’s Parliament and signed by Asif Ali Zardari, transfers many constitutional-jurisdiction powers from the Supreme Court of Pakistan (SC) to the FCC, expanding federal-provincial disputes and constitutional interpretation under the new court’s remit.
Justice Aminuddin, born December 1 1960 in Multan, rose from advocate to judge of the Lahore High Court in 2011, and then to the Supreme Court in 2019. He was sworn in today at the President’s House in Islamabad, with top judicial and military officials in attendance.
The creation of the FCC and appointment of its first Chief Justice mark a major shake-up in Pakistan’s judicial architecture. Critics warn that the changes could weaken judicial independence, while supporters claim they modernise constitutional adjudication. The next months will test how the FCC functions in practice - and whether it strengthens or diminishes the judiciary’s role in Pakistan’s democracy.
